1. The business

2. Scope

These terms apply to every order you place with Yuko Sushi: online, by phone or in our restaurant. By placing an order you accept them.

3. Offer and prices

All prices shown are in euros and include VAT. Images of dishes are illustrative; the actual presentation may differ. We keep our menu as up to date as possible, but a dish may be temporarily sold out. If a dish turns out to be unavailable after you have ordered, we will contact you and you can choose between an alternative or a refund for that dish.

4. Formation of the contract

The contract is formed as soon as we confirm your order by email or by phone. We reserve the right to refuse an order, for example if the delivery address lies outside our delivery area, if we suspect misuse, or if we cannot meet the preparation time because of how busy we are. We will let you know as soon as possible and refund any amount already paid in full.

5. Payment

You can pay online with the payment methods offered on the website, or in cash and by card in our restaurant. Online payments are handled by a specialist payment provider; your card details do not reach us. For delivery, a minimum order value applies per area. You always see the full amount before you finalise the order.

6. Delivery and collection

We prepare and deliver during our opening hours: Tuesday to Sunday from 14:30 to 23:30. We are closed on Mondays. Collection is at Statiestraat 22 in Antwerp.

Delivery times mentioned are indicative and not strict deadlines. We do our utmost to meet them, but busy periods, weather and traffic can cause delays. Please make sure you are reachable at the address given. If we cannot reach you after repeated attempts, we may treat the order as delivered and the amount remains payable.

7. Right of withdrawal

Op vers bereide, bederfelijke etenswaren en op maat samengestelde gerechten geldt het wettelijke herroepingsrecht niet. Dit volgt uit Boek VI van het Wetboek van economisch recht. Zodra de bereiding is gestart, kan een bestelling daarom niet meer kosteloos worden geannuleerd.

8. Cancelling or changing

If you want to change or cancel your order, call us as soon as possible on +32 466 32 63 57. If preparation has not yet started, we are happy to adjust it or cancel free of charge. Once preparation has begun, cancellation is no longer possible.

9. Allergens and food safety

We prepare everything fresh in our own kitchen. Traces of allergens can therefore end up in any dish, even when the ingredient is not in the recipe. If you have an allergy or intolerance, please tell us before you order, by phone or with your order. Our staff have up-to-date allergen information for each dish. 10. Complaints

If you are not satisfied, please let us know within a reasonable time via our complaints page, by phone or by email. We reply within two working days and usually find a solution within seven working days.

If we cannot resolve it together, as a consumer you can turn free of charge to the Consumer Mediation Service, Koning Albert II-laan 8 box 1, 1000 Brussels (consumentenombudsdienst.be).

11. How we treat each other

Our staff and couriers do their best every day to get your order to you fresh, hot and on time. We expect them to be treated with respect — at the door, on the phone and in our restaurant.

In the event of aggression, threats, discrimination or inappropriate behaviour towards our people, we end the contact. We may then cancel a current order and refuse future orders. If an order has already been paid for and is therefore not delivered, we assess case by case what is reasonable.

Conversely, you may expect the same from us. If one of our staff or couriers does not treat you properly, please tell us. We take every report seriously and find out what happened.

12. If something goes wrong

Something can always go wrong: a missing dish, a late order, or something that isn’t what you expected. Please tell us, ideally as soon as possible and preferably the same day, so that we can still put it right.

We take every report seriously and handle it at no cost to you. Depending on the situation we look for a suitable solution: preparing and delivering again, refunding the amount for the dish in question, or another arrangement you consider reasonable. Our aim is that you end up satisfied with how we resolved it, even when it went wrong the first time.

If it concerns a health complaint or a reaction to an allergen, contact us immediately by phone on +32 466 32 63 57. We handle that as a priority.

13. Liability

We are liable for damage resulting from a failure on our part. For indirect and consequential damage, our liability is limited to the amount of the order concerned.

This limitation does not apply in the event of intent or gross fault, nor in the event of death or personal injury. We never exclude or limit that liability. Your statutory rights as a consumer remain fully applicable.

We are not liable for damage arising from incorrect or incomplete details you provided yourself, such as a wrong delivery address or an allergy you did not report.

14. Force majeure

In the event of force majeure — such as a power cut, a technical failure, extreme weather or government measures — we may suspend performance or terminate the contract. If you have already paid for an order we cannot deliver as a result, we refund that amount in full.

15. Applicable law

Belgian law applies to these terms. Disputes are submitted to the competent court of the judicial district of Antwerp, unless the law mandatorily designates another court. As a consumer you always retain the right to bring the case before the court of your place of residence.

16. Changes

We may amend these terms. Your order is always governed by the terms as they appeared on this page at the time of ordering.
